TERMS AND CONDITIONS — MILA MONTREAL

1. SCOPE AND CONTRACTING PARTY

These Terms apply to purchases made through https://milamontreal.ca.

The store operator and contracting party is:

Mila Montreal is the trade name used for this online store. The brand name does not represent a physical shop, office, workshop, or fulfillment location in Montreal or Canada unless expressly stated otherwise.

2. ELIGIBILITY

You must have legal capacity to enter into a purchase contract. If you are under the age of majority where you live, a parent or legal guardian must place the order or authorize it as required by law.

3. PRODUCTS AND PRODUCT INFORMATION

The product description, photographs, measurements, materials, and notices shown on the product page at the time of order form part of the purchase information.

Screen settings may cause minor colour differences. We describe manufacturing method, origin, material, and special characteristics only when supported by the relevant product information.

4. ORDERS AND CONTRACT FORMATION

Product listings are invitations to place an order. By submitting the order, you make an offer to purchase the selected products. An automatic order confirmation acknowledges receipt but does not necessarily mean acceptance. A contract is formed when we expressly accept the order or dispatch the goods.

We may decline or cancel an order before acceptance because of unavailability, an obvious price or description error, failed payment, suspected fraud, or a shipping restriction. Any amount already collected for a cancelled order will be refunded.

5. PRICES, CURRENCY, AND TAXES

Prices are displayed in Canadian dollars, CAD. Applicable federal and provincial sales taxes are calculated and displayed at checkout where required. The checkout displays the total payable amount before you submit the order.

Standard shipping is free, and Mila Montreal pays applicable import duties, brokerage fees, and import-clearance charges on properly processed shipments.

6. PAYMENT

Available payment methods are displayed at checkout and processed through Shopify Payments and the payment providers shown there.

We do not store full payment-card numbers or security codes. You authorize the applicable charge when placing an order. Additional authentication may be required.

7. SHIPPING AND DELIVERY

We ship only to Canada.

Orders normally require 1–3 business days for processing, quality checks, and packing. After dispatch, delivery normally takes 8–12 business days, for an estimated total delivery time of 9–15 business days from the date of order.

Products are checked, packed, and dispatched directly by our international fulfillment partner in Ningbo, China.

8. TITLE AND RISK

Title remains with us until full payment, to the extent permitted by law.

Risk of loss transfers as provided by the mandatory law applicable to the sale. Nothing in these Terms transfers carrier risk to a consumer earlier than permitted by law.

9. RETURNS, REFUNDS, AND CANCELLATIONS

We provide a voluntary 30-day return period beginning on the date you receive your order.

The customer pays return shipping to our central warehouse in Asia for a change of mind, incorrectly selected size, incorrectly selected colour, or another reason not caused by an incorrect, damaged, or defective item.

We pay reasonable return costs for an incorrect, damaged, or defective item.

Nothing in these Terms excludes rights that cannot be waived under the consumer-protection legislation of your province or territory.

10. DEFECTIVE GOODS AND STATUTORY RIGHTS

Mandatory statutory warranties, implied warranties, consumer guarantees, and other remedies remain in effect.

Contact info@milamontreal.ca if a product is incorrect, damaged, or defective. We will provide the remedy required by applicable law and pay reasonable return costs in a valid claim.

11. INTELLECTUAL PROPERTY

Website text, graphics, photographs, branding, and design may be protected by intellectual-property laws.

You may use the website for personal shopping purposes but may not reproduce or commercially exploit protected content without permission or another lawful basis.

12. ACCEPTABLE USE

You must not misuse the website, introduce malicious code, attempt unauthorized access, scrape the service in a harmful manner, commit fraud, or infringe another person's rights.

13. LIABILITY

We do not exclude or limit liability where doing so is prohibited by law, including liability for fraud, wilful misconduct, gross negligence where applicable, personal injury caused by negligence, or mandatory product liability.

For other claims, any limitation applies only to the maximum extent permitted by applicable law. Some jurisdictions do not allow certain exclusions, so those exclusions may not apply to you.

14. PRIVACY

Our collection and use of personal information are described in the Privacy Policy and, where applicable, the cookie consent interface.

15. GOVERNING LAW

To the extent permitted by law, these Terms are governed by the applicable laws of Canada and the applicable laws of the province or territory connected to the transaction.

This does not deprive a consumer of mandatory protections or courts available under the law of the jurisdiction where the consumer resides.

16. CHANGES AND SEVERABILITY

The Terms in force when an order is placed apply to that order.

If any provision is invalid or unenforceable, the remaining provisions continue to apply, and mandatory law replaces the affected provision where required.
